General Terms and Conditions (GTC)
butter.fly F&B GmbH / "butter.fly | brunch & bar. coffee & cocktails."
§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all contracts for catering, the sale of food and beverages and table reservations between the guest and butter.fly F&B GmbH (hereinafter referred to as “butter.fly”).
§ 2 Conclusion of Contract
(1) The catering contract is concluded as soon as the guest places an order and it is accepted by our staff.
(2) For reservations, a binding contract is concluded upon confirmation by butter.fly (online, by e-mail or verbally).
§ 3 Prices and Payment
(1) All prices are in euros and include the applicable statutory value added tax.
(2) Payment is due immediately after the meal. We accept cash as well as the electronic payment methods displayed on site.
(3) Tips are voluntary contributions and are not part of the bill.
§ 4 Reservations, cancellations and no-shows
(1) Reserved tables will be held for a maximum of 15 minutes beyond the agreed time. After that, the reservation expires.
(2) To ensure all guests can enjoy the butter.fly experience, the duration of stay per reservation is limited as follows:
- 1 to 6 persons: 2 hours (120 min)
- 7 or more persons: 2.5 hours (150 min)
There is no entitlement to an extension. After this period, butter.fly reserves the right to reassign the table.
(3) In addition, reservations are subject to the terms and conditions accepted when booking via the reservation tool.
(4) We reserve the right to charge a cancellation fee of €10.00 per person in the event of a no-show or cancellation less than 24 hours before the scheduled time, provided the table could not be reassigned. The guest is entitled to prove that the actual damage incurred was less.
(5) A reservation for the outdoor area does not entitle the guest to a seat indoors in the event of poor weather. Moving indoors is only possible subject to availability and consultation with staff. If outdoor service is not possible due to weather conditions and no indoor seats are available, butter.fly reserves the right to cancel the reservation at short notice. Claims for damages are excluded in such cases.
§ 5 Defects and Warranty
(1) The guest is obliged to report any obvious defects in food or beverages to the staff immediately.
(2) A complaint after almost complete consumption of the goods is excluded.
(3) In the case of justified defects, the goods will be remedied (e.g., by providing a replacement). A price reduction is only possible if the remedy fails.
§ 6 Bringing your own food and drinks
(1) Bringing and consuming your own food and drinks is prohibited. The permission to consume baby food brought from home is at the discretion of the staff on site.
(2) Bringing your own cakes/pies (e.g., for celebrations) is only permitted after prior arrangement. In this case, we will charge a reasonable platter fee based on the effort involved. There is no general entitlement to bring your own.
§ 7 House Rules and Laptop Policy
(1) butter.fly is a place for hospitality and social interaction. Instructions from staff must be followed.
(2) Laptop use: On Saturdays, Sundays and public holidays, as well as after separate announcement by the staff on site, the use of laptops and tablets is prohibited in the entire dining area (10:00–18:00).
(3) On weekdays (Mon-Fri), use is permitted for a maximum of 60 minutes and only in the areas expressly authorized by staff. There is no entitlement to a workspace or power outlet.
§ 8 Minimum turnover and consumption obligation
(1) We reserve the right to require a minimum consumption of €12.50 per person/hour during peak times or when using technical infrastructure (e.g. Wi-Fi, power outlets).
(2) Tables occupied for more than 90 minutes require a reasonable subsequent purchase.
§ 9 Damage and Excessive Soiling
(1) Guests are obliged to treat the inventory, table decorations (especially lamps and vases), and the premises of butter.fly with care. Accompanying persons and legal guardians must fulfill their duty of supervision.
(2) In the event of intentional or grossly negligent damage to inventory or decoration, the guest (or the legal guardians in case of breach of supervision duty) is liable for the resulting damage.
(3) In cases of soiling exceeding normal use (e.g., vomiting, improper use of toilets, intentional bringing in of coarse dirt such as mud, or soiling of upholstered furniture) that requires special cleaning or technical repair, butter.fly will charge a flat-rate cleaning fee of €50.00. The right to claim higher actual costs is reserved. The guest reserves the right to prove that lower damage occurred.
§ 10 Wi-Fi Usage
(1) butter.fly provides guest Wi-Fi subject to availability. Use is at your own risk.
(2) Liability is governed by statutory provisions, in particular the German Telemedia Act (TMG). Liability for interference is excluded; however, the guest is liable for all damages resulting from unlawful use of the Wi-Fi (e.g., copyright infringements) and shall indemnify butter.fly against third-party claims.
§ 11 Liability
(1) butter.fly shall be liable without limitation for damages resulting from injury to life, body or health.
(2) butter.fly shall only be liable for other damages, in particular loss of clothing or electronic devices, in cases of intent or gross negligence.
§ 12 Final Provisions & Dispute Resolution
(1) The law of the Federal Republic of Germany shall apply.
(2) If the guest is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes shall be the registered office of butter.fly F&B GmbH.
(3) Online dispute resolution: The European Commission provides a platform for online dispute resolution (ODR), which you can access at https://consumer-redress.ec.europa.eu/index_de Find us. Our email address is: management@mybutterf.ly.
(4) Consumer dispute resolution: butter.fly is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
(5) Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
(6) The governing language of this agreement is German. Any translations of these General Terms and Conditions (GTC) are provided for information purposes only. In the event of any conflict or discrepancy between the German version and any translation, the German version shall prevail.
